Terms of Service

These terms cover your use of whowins.lol, operated by whowins.lol ("we", "us"). By adding a link or paying for a seat you agree to them. If you do not agree, do not use the site. The operator's address, tax number, phone and email are at the bottom of this page.

1. What the service is

whowins.lol is a public directory and leaderboard of software products. Anyone can browse it. Each position on a board is a seat. Putting a link on a seat nobody holds costs $5, the same amount on every board. A seat that already has a holder is taken by paying more than the last payment on it. In both cases the seat changes hands as soon as the payment clears.

2. What you are paying for

You are paying for the seat itself, and it is delivered immediately. There is no contest, no waiting period and no outcome to wait for. When your payment clears:

• your link moves into the position you paid for, and the previous holder moves down one;
• the amount you paid becomes the number the next person has to pay more than;
• your listing is shown in that position on the board and in the category listing;
• a share image and share links are generated for your listing;
• visits we send from that position to your site are counted and shown to you.

The fee is not a wager and not an entry into a game of chance. Nothing about it is random and nothing is decided by anyone else: the price is published before you pay, and paying it is what transfers the seat.

• A seat with no holder costs $5. That is a one-off payment, not a subscription.
• A held seat costs more than the last payment on it, and the amount is published before you pay.
• The seat is transferred as soon as the payment clears.
• A seat you hold can be taken by somebody who pays more than you did. That is the rule you are buying into, and it applies to every seat including the one you just took.
• The seat is delivered in full at the moment of payment, which is why the fee is not refundable. See the refund policy.

3. Immediate delivery, and what that costs you

What you buy is digital and there is nothing to ship. It is placed on the public board within seconds of the payment clearing, without waiting for you to ask for it again.

Where the law gives a consumer a cooling off period for a distance purchase, that period does not survive digital content that the buyer asked to have delivered straight away. By ticking the box at checkout and paying, you are doing two things at once, and both are conditions of the sale:

• you expressly ask us to place your link on the seat immediately, before any cooling off period would have run out;
• you accept that once it is placed you lose the right to withdraw from the purchase and get the money back, because the thing you bought has already been delivered in full.

If you do not want to give up that right, do not pay. There is no version of this purchase where the seat is held back and delivered later.

4. Who can buy

You have to be old enough to enter a contract where you live, at least 18, and paying with a card or account you are entitled to use. If you are paying on behalf of a company, you are confirming that you are allowed to commit that company.

5. Adding a link

Anyone can pay to add a link, and you do not have to own what you add. A listing is not a claim of ownership and does not mean the linked product is connected to us or endorses us. Listings that are misleading, illegal, or infringe someone else's rights are removed under section 7.

6. Content you provide

You keep ownership of your product name, description and logo. You give us permission to display them on the site, in leaderboards, on listing pages and in the share images we generate. You are responsible for having the right to give that permission.

7. Suspension and removal

We may suspend or remove a listing without notice if:

• the link no longer resolves or now points somewhere else;
• the listing is misleading, illegal, or infringes someone else's rights;
• a payment is reversed or disputed;
• the listing is used to abuse the site or the people on it.

If we remove a seat you paid for because of something on this list, the fee is not returned. If we remove it for a reason of our own, we return what you paid for it.

8. Availability, and changes to these terms

We do not promise the service will be uninterrupted. We may change how the boards or the pricing work. The price shown to you at the moment you pay is the price that applies to that payment, and a later change never makes a completed payment cost more.

We may also change these terms. The version published on this page when you pay is the version that governs that payment, and the date it was last changed is at the top of the page. A change never applies backwards to a payment you have already made.

9. Limits

To the extent the law allows, we are not liable for indirect or consequential loss, including lost revenue or lost visibility. Our total liability for any claim is limited to what you paid us in the three months before the claim. Nothing in this section limits liability that cannot legally be limited, including liability for fraud, for death or personal injury caused by our negligence, or a consumer right that cannot be set aside by agreement.

10. Payments, currency and seller of record

Payments are processed by a merchant of record, which appears as the seller on your statement, issues your invoice in its own name and handles sales tax and VAT. The merchant of record emails you a payment confirmation and a tax invoice for every payment, and gives you a portal link to look them up again later.

Every amount on this site is in US dollars. If your card is in another currency, your bank converts it at its own rate and may add its own fee. We never see or store your card number.

If you do not recognise a charge, write to info@whowins.lol before you raise a chargeback. A chargeback on a seat that was delivered lets us remove the listing under section 7 and refuse further payments from you, and we contest it with the record of when the seat moved.

11. Complaints, governing law and disputes

Write to info@whowins.lol with what happened, the listing address and the transaction reference. We answer within two business days and try to settle it directly. Most disputes here are a seat that did not move, and that is fixed in minutes once we can see the payment.

These terms are governed by the laws of Türkiye, and the courts and enforcement offices of İzmir, Türkiye have jurisdiction. If you buy as a consumer, this does not take away the protection of the mandatory consumer law of the country you live in, and it does not stop you going to a consumer arbitration committee or court there. Consumers in Türkiye may also apply to the district consumer arbitration committee or the consumer court where they live.

If a payment itself is in dispute rather than the seat, the merchant of record that appears on your statement also runs its own buyer complaint process, and using it does not affect anything in this section.
